The swim program operates on an ongoing basis for 50 weeks per calendar year. Classes do not run for 2 weeks over the Christmas and New Year Holiday period (subjection of confirmation of dates by Balance Health Clubs). All bookings are subject to the availability and are at the discretion of the Balance Health Clubs. Classes do not run on Public Holidays. Balance Health Clubs reserves the right to terminate participation in the swim program at any time.
Payment Options
All classes in the swim program are subject to direct debit and must be paid in accordance with the direct debit request issued by Balance Health Club.
No transfers, refunds or suspension periods apply. If a member wishes to be released from the swim program it must give Balance Health Club at least 30 days written notice of cancellation and fees will be charged during the cancellation period. Payment will be deducted from the nominated account on the 1st working day of each month. In the event of a direct debit rejection, a rejection fee of $10.00 will be charged to the account (subject to variation by Balance Health Club). Fees will continue to be debited from the chosen account until the member or Balance Health Club cancels the arrangement in line with these terms & conditions and the direct debit request. If at any time any fees are overdue, Balance Health Club may terminate the child’s participation in any class with immediate effect. In the event of an overdue account being referred to a debt collection agency, the member will also become liable for all fees as well as collection costs and legal demand costs which will be added to the member’s account.
Cancellation Of Class
A maximum of 1 class every 4 weeks may be cancelled no later than 1 hour prior to the class start time, otherwise the class will be forfeited and the full class fee is payable. The child is not entitled to a makeup class when a class is forfeited. Makeup classes must be used within 4 weeks of the missed class.
There is no cancellation and rebooking of a makeup class. All makeup classes are subject to availability and are at the discretion of Balance Health Club.
Pool Rules
Balance Health Clubs is a non-smoking venue. All patrons must shower before entering the pool. Swimming caps are required to be worn in the pool.
Children under the age of 10 years old must be supervised at all times by a Parent/Legal Guardian. Members are responsible for the Child at all times.
Please obey the pool attendants directions at all times. Running, diving, bombing, spitting, pushing, dunking and ball games are not permitted in the facility. Patrons must check pool depth before entering. Non swimmers should not go in over their depth. Patrons should stay clear of deep water unless confident swimmers. Only recognised swimwear is to be worn in the pool. Only recognised waterproof nappies are to be worn in the pool for infants.
Banned items are not permitted in Balance Health Clubs. This includes but is not limited to scooters, skateboards and balls of any kind. No pets or animals are permitted at Balance Health Clubs, with the exception of Guide Dogs. No cameras, video cameras or mobile phone cameras permitted in change rooms. Patrons under the influence of drugs or alcohol are not permitted at Balance Health Clubs. No glass objects or alcohol allowed. Abusive, disruptive or offensive behaviour and language are not permitted.
Damages/Personal Injury
I acknowledge and agree that I am aware that the use of the Balance Health Clubs premises and its facilities and the participation in the classes and programs conducted by Balance Health Clubs including the Swim Program may involve strenuous activity and risk (special or otherwise) associated with such use and participation and such activities are done so at the Child’s risk. I release Balance Health Clubs and its directors, employees, contractors and agents (the ‘Staff’) from all liability and responsibility whatsoever. This includes personal injury, property damage or death however caused, but not limited to the negligence (whether passive or active) of Balance Health Clubs or its Staff or any other person using the premises. I agree to assume the risk of any injuries, damage or loss that the Child or I may sustain as a result of being a participant in the classes and Swim Program conducted by Balance Health Clubs or by using the Balance Health Club premises and facilities.
Balance Health Clubs guarantees that its fitness and recreational services and Swim Program are provided with due care and skill, fit for the intended purpose and are supplied within a reasonable time as provided for in the Competition and Consumer Act 2010 (Cth) (‘CCA’). To the extent permitted by s139A of the CCA, Balance Health Clubs excludes all liability in connection with the supply of recreational services for death, physical or mental injury, or property damage resulting from a failure of Balance Health Clubs to comply with a guarantee in sections 60-62 of the Australian Consumer Law (‘ACL’) (in Schedule 2 of the CCA). This exclusion of liability does not apply where significant personal injury is caused by the reckless conduct of Balance Health Clubs in accordance with s139A of the ACL.
Responsibility For Damage
I acknowledge and agree that I am solely responsible for any damage caused by me or the Child to Balance Health Clubs, its facilities, services, products or equipment, if such damage is caused by my or the Child’s wilful act and/or negligence.
Fitness To Participate
I declare that the Child and I are medically and physically fit and free from impairment and able to participate in the fitness activities and Swim program the Child and I have undertaken or will undertake all necessary medical and/or fitness assessments and examinations.
Privacy Statement
Western Suburbs (Ncle) Leagues Club Limited (and all subsidiaries) (ABN 24 000 973 919) collects personal information including sensitive health information about you and the Child as provided by you via this form and or as otherwise provided by you physically or electronically. Wests collects personal information for the purposes of assessing your application for registration, for maintaining complete records of pre-activity applications, to verify previous health or medical history, to monitor your and the Child’s progress during the length of membership, to assess any future application for membership by you and to provide its health club services. Personal information we collect about you and the Child may be combined with information that we obtain from our business partners or other third party sources such as your Doctor who hold your consent to disclose your personal information to us or who disclose your personal information to us in circumstances where it is lawful to do so. For any of the purposes described above, your information may be shared with our group companies (and their directors, servants and agents). Failure to provide personal information may result in you being unable to apply for registration and in us being unable to provide you with certain products or services. Our Privacy Policy contains information about how you can access and correct your personal information, how you can lodge a complaint regarding the handling of your personal information and how any complaint will be handled.
